(the “Pharmacy”) is committed to protecting your personal information, i.e., any information which relates to a natural person and directly or indirectly allows that person to be identified (the “Personal Information“) as defined by the Act respecting the protection of personal information in the private sector (Québec) or by any other applicable legislation (the “Applicable Legislation“).

This Privacy Policy (the “Policy“) describes how we collect, use, disclose, process and store your Personal Information in the course of our business, including through the operation and functionalities of the website accessible at https://pharmaciedvmh.com/en/ (the “Website“) along with any related services offered online or in person by the Pharmacy (collectively, the “Services“).

By accessing, subscribing to, or using our Services, you consent to the collection, use, disclosure, and processing of your Personal Information by the Pharmacy in accordance with this Policy. Refusal to abide or be bound by this Policy means you may not visit, access, or use our Services nor share your Personal Information with us.

Note that this Policy does not apply to the Personal Information of employees, representatives, and consultants of the Pharmacy, nor to any other person it is affiliated with. Additionally, it does not apply to information that does not meet the legal definition of what constitutes Personal Information.

  1. Application
    This Policy applies to the Pharmacy and all its affiliates and subsidiaries (collectively, the “Affiliates“), their websites and functionalities, as well as all related services offered online or in person by the Affiliates (the “Affiliated Services“), to the extent that any of these Affiliates collect, use, disclose or receive Personal Information as part of the operation of our Services.

    Please note that some Affiliates may have their own websites, sub-domains, applications, or services on other websites that may be subject to privacy policies separate from this Policy.

  2. Changes to the Policy
    We reserve the right to update and modify this Policy at any time in accordance with Applicable Legislation. If changes are made, we will post the revised version and update the “Last updated” date at the top of this page. If you do not agree to any of the proposed changes to the Policy, we encourage you to stop using our Services. Continuing to use our Services after the posting of the revised Policy is considered consent to the changes made.

    1. Processing of Personal Information
      The Personal Information that may be processed when using our Services includes, but is not limited to:
      • contact information, such as your first and last name, postal and e-mail addresses, telephone number and date of birth;
      • information relating to products or services, such as your appointments and information concerning our Services;
      • information you choose to provide or send us when filling in a form, answering surveys or communicating with one of our employees or representatives, for example; and
      • information collected automatically when you use our Services, including:
      • logins and other information about your activity on the Website, such as your IP address, geolocation date, the pages you visit, the time and date of your visits, the type of browser you use, your device’s operating system;
      • as well as other hardware and software information;

      In each of these cases, we process Personal Information in accordance with the legitimate and essential purposes specified in subparagraph 3.2 of the Policy.

    2. Use of Personal Information
      We reserve the right, at our discretion, to use your Personal Information for the following legitimate and essential purposes:
      • Manage, maintain, supervise, develop, improve and offer the functionalities of our website;
      • Provide services and ensure the proper operation of our website;
      • Improve our Services and design new features or options for our website;
      • Send you account-related messages, updates, security alerts and notifications;
      • Carry out marketing and business development activities, provided that we have received your prior consent for the processing of your Personal Information for these purposes;
      • Answer your questions and provide assistance when needed;

      Note that the Personal Information collected will not be used to make any inferences or interpretations whatsoever.

      We may share or transfer your Personal Information with our employees, contractors, consultants, agents, service providers and other trusted parties acting on our behalf (collectively, the “Service Providers”) when necessary for the operation of our Website, the management and protection of our business activities, or to provide our Services to you.

      Such sharing or transfer may occur in the following circumstances:

      • Bonjour – santé or Telus santé – We use online appointment services to book appointments online. See their Privacy Policy;
      • Google Optimize – We use Google Optimize to evaluate the performance of different website pages. See their Privacy Policy.
      • Google Tag Manager – We use it to manage tracking codes and code fragments (“tags”). See their Privacy Policy;
      • Meta (Facebook) – We use it to promote our Services. See their Privacy Policy;
      • Vimeo – We use it as a platform to share videos we create. See their Privacy Policy.

      Know that we make sure to enter a written agreement with our Service Providers before sharing or transferring your Personal Information to make sure we strictly send them the Personal Information required for the fulfillment of their mandate. Through these agreements, we ensure that the conditions of this Policy and Applicable Legislation are respected. The Service Providers are also required to follow our guidelines and to use Personal Information only for the purposes for which it was provided to us. Note that we do not sell, trade, or otherwise share your Personal Information with third parties, except as provided by Applicable Legislation or if we have obtained your prior consent.

    4. Compliance with Applicable Legislation
      We reserve the right to disclose your Personal Information when we believe it is permitted, necessary or appropriate in accordance with Applicable Legislation. Such disclosure of your Personal Information may be used, among other things, to:

    5. Sharing of Personal Information as Part of a Business Transaction
      In the event of a sale, the partial or total transfer, or the assignment of our organization, we reserve the right to share, transfer or disclose your Personal Information. Such an occurrence could happen in the case of a merger, reorganization, or other business transaction, including negotiations for such transactions. In such a case, we will notify you prior to the transfer of your Personal Information.
    6. Prior Consent
      The Pharmacy commits to using your Personal Information only for the purposes for which it was initially collected, in accordance with this Policy. We will seek your consent before using your Personal Information for purposes other than those explicitly set out in this Policy, subject to the limits of Applicable Legislation.

      We will directly reach out to you to obtain consent to collect, use and share your Personal Information. However, if you provide us with Personal Information concerning other persons, you must duly notify them of your intention to share said information with us and ensure that you have obtained their consent before doing so, or that you have parental authority over said persons.

    7. Retention of Personal Information
      We retain your Personal Information only for as long as reasonably needed to fulfill the purposes for which it was collected, in accordance with this Policy and Applicable Legislation.       In addition, the Pharmacy will retain user and patient data for as long as required by the Pharmacy. We commit to deleting the data of any other pharmacy we collaborate with as well as that of its users and patients upon request by said pharmacy.

  4. Your Rights Regarding Your Personal Information
    As a data subject, you may exercise the rights provided for by the Applicable Legislation. These include:
    • The right to know which of your Personal Information we hold and to obtain a copy of said information;
    • The right to request the correction of any Personal Information we hold that is inaccurate, incomplete or misleading;
    • The right to request the rectification of Personal Information whose collection, communication or retention contravenes Applicable Legislation;
    • The right to demand that we stop disseminating your Personal Information or that we deindex any hyperlink linked to your name providing access to such information if such dissemination contravenes Applicable Legislation or a court order;
    • The right to request the deletion of Personal Information that is out-of-date or that its use, possession or collection is longer justified by Applicable Legislation;
    • The right to revoke your consent to the communication or use of your Personal Information for specific purposes, including commercial prospecting;
    • The right to file a complaint with the competent data protection authority, subject to the conditions of the Applicable Legislation.

    To provide you with the best experience possible, we use cookies and other tracking technologies (collectively, “Cookies”), unless you have set your browser or device to block some or all Cookies. These Cookies help us manage, protect, and optimize our website, improve our Services, and personalize your browsing experience according to your interests.

  6. Safeguards
    The Pharmacy implements a series of sector-appropriate physical, administrative, technological, and organizational safeguards to ensure the confidentiality and security of your Personal Information against loss, theft and unauthorized access, disclosure, reproduction, communication, use, modification, or destruction. One example is that Service Providers are required to sign confidentiality agreements. Furthermore, we regularly reassess our protection measures and procedures, and adjust them as necessary.

    However, although we take all protective measures required by Applicable Legislation, it is impossible for us to guarantee the total security of your Personal Information. Therefore, if you have any reason to believe that your data is no longer secure, please contact our Privacy Officer immediately (contact information below).

  7. Link to Third-Party Services
    From time to time, we may include references or links to websites, content, products, or services provided by third parties (the “Other Services“) on our website. Please note that these Other Services are not operated nor controlled by the Pharmacy and are governed by separate privacy policies independent of ours. Consequently, we are not responsible for the content or activity on these websites. This Policy applies exclusively to our Services and does not extend to any Other Services.
  8. Personal Information of Minors Under the Age of 14
    We do not knowingly collect or use Personal Information from minors under the age of 14. If you are a minor under the age of 14, we ask that you do not provide us with your Personal Information without the prior consent of who has parental authority over you. If you have parental authority over a child and discover that child has provided us with Personal Information without your consent, please contact our Privacy Officer using the contact information provided below to request said Personal Information be deleted from our systems.

    Please note that only a person having parental authority over a minor under the age of 14 may access or change the Personal Information of that minor.
